* License
Under this License you may (1) use the Software only on a single computer at a time, except that the Software may be executed from a common disk shared by multiple CPUs provided that one authorized copy of the Software has been licensed  from Micromat for each CPU executing the Software (2) make one copy of the Software in machine readable form, provided that such copy of the original may be used solely for backup purposes. The Software is protected by copyright law. As an express condition of this License, you must reproduce on each copy the Micromat copyright notice  and any other proprietary legends that were on the original copy supplied by Micromat. This restriction on copying the Software expires upon the expiration of all underlying copyrights on copying the Software (3) transfer the Software and all rights under this license to another party together with a copy of this License and all written materials accompanying the Software, provided you give Micromat written notice of the transfer and the other party reads and agrees to accept the terms and conditions of this License.

* Restrictions
You may NOT distribute copies of the Software to others or electronically transfer the Software from computer to another over a network. The Software contains trade secrets and to protect them you may NOT decompile, reverse engineer, disassemble, or otherwise reduce the Software to a human perceivable form.  YOU MAY NOT MODIFY,  ADAPT, TRANSLATE, RENT, LEASE, LOAN,  RESELL FOR PROFIT, DISTRIBUTE, NETWORK, OR CREATE DERIVATIVE WORKS BASED UPON THE SOFTWARE OR ANY PART THEREOF.

* Termination
This License shall remain in effect until terminated.  This License will terminate immediately without notice from Micromat if you fail to comply with any provision of this License.  Upon termination you must destroy the Software and all copies thereof.

* Disclaimer
Warranty Disclaimer, Limitation of Remedies and Damages:
The Software product will perform   substantially in accordance with the documentation supplied with it.  If, within thirty (30) days after your purchase, the product fails to do so, Micromat shall use its best efforts to replace the defective diskette or document that corrects such failure.  If such replacement is not feasible or does not resolve the failure, Micromat may, at its option, refund to you your purchase price upon receipt of the original product with all documentation and proof of purchase, which shall constitute your sole and exclusive remedy in the event of such failure.

The medium on which this Software is recorded shall be free from defects in material and faulty workmanship under normal use and service for a period of thirty (30) days from the date of purchase.  If during this period you find a defect in the medium , it should be returned to Micromat Computer Systems Inc., 1055 West College Avenue #333 Santa Rosa, CA 95401, postage prepaid, with proof of purchase.   Your sole and exclusive remedy in the event of such a defect is expressly limited to replacement of the medium as provided herein.  After thirty (30) days, to receive a replacement, you should send the defective medium (including the original product label) to Micromat at the above address, a $10.00 check or money order in U.S. funds ($12, Canadian funds), a brief statement describing the defect, and your return address.

Micromat does not warrant that this product will meet your requirements or that the operation of the product will be uninterrupted or error free.  You assume responsibility for the selection of the program to achieve your intended results and for the installation, use, and results obtained from the program.  Although changes or improvements to the Software, diskette, and/or documentation may be made, Micromat is under no obligation to provide them to you.  This product should be used only with the computers, disk drive, printers, and other components specified in the accompanying documentation.  Micromat is not responsible for problems caused by changes to Apple System software, computers, or other components that are made after the initial release of this product.

* Complete Statement of Warranty
THE LIMITED WARRANTIES PROVIDED ABOVE ARE THE ONLY WARRANTIES OF ANY KIND THAT ARE MADE BY MICROMAT ON THIS PRODUCT.  NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY MICROMAT, ITS DEALERS, DISTRIBUTORS,  AGENTS,  OR EMPLOYEES SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF THIS WARRANTY, AND YOU MAY NOT RELY ON ANY SUCH INFORMATION OR ADVICE.  THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS IN THE UNITED STATES.  YOU MAY HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.

* Limitation of Liability
IN NO EVENT WILL MICROMAT, OR ITS DEVELOPERS, DIRECTORS, OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, INCIDENTAL, OR INDIRECT DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, AND THE LIKE) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE OR ACCOMPANYING WRITTEN MATERIALS EVEN IF MICROMAT OR AN AUTHORIZED MICROMAT REPRESENTATIVE HAS BEEN ADVISED  OF THE POSSIBILITY OF SUCH DAMAGES.  BECAUSE SOME STATES IN AMERICA DO NOT ALLOW THE EXCLUSION OF LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Micromats liability to you for actual damages for any cause whatsoever, and regardless of the form of the action, will be limited to the greater of $100 or the money you paid for the Software that caused the damages.

* U.S. Government Restricted Use Provisions
If this Software is acquired by or on behalf of a unit or agency of the United States Government, this provision applies.  This Software was developed at private expense, and no part of it was developed with government funds.  It is a trade secret of Micromat for all purposes of the Freedom of Information Act, is commercial computer software subject to limited utilization as provided in the contract between the vendor and the governmental entity and, in all respects is proprietary data belonging solely to Micromat.

For units of the Department of Defense (DOD), this Software is sold only with Restricted Rights as that  term is defined in the DOD Supplement to the Federal Acquisition Regulations, 52.227-7013(c)(1)(ii) and use, duplication or disclosure is subject to restrictions as set forth in subdivision (c)(1)(ii) of the rights in Technical Data and Computer Software clause at 52.227-7013. If this Software was acquired under a GSA Schedule the U.S. Government has agreed to refrain from changing or removing any insignia or lettering from the Software or accompanying written materials that are provided or from producing copies of manuals or disks (except one copy for backup purposes) and title to and ownership of this Software and documentation and any reproductions thereof shall remain with Micromat.  Use of this software and documentation shall be limited to the facility for which it is acquired and if use of the Software is discontinued to the installation specified in the purchase/ delivery order and the U.S. Governments desires to use it at another location, it may do so by giving prior written notice to Micromat, specifying the type of computer and new location site. U.S. Governmental personnel using this Software, other than under a DOD contract or GSA Schedule, are hereby on notice that use of this Software is subject to restriction which are the same as or similar to those specified above.

APPLE COMPUTER, INC. MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, REGARDING THIS SOFTWARE. APPLE DOES NOT WARRANT, GUARANTEE OR MAKE REPRESENTATION REGARDING THE USE OR THE RESULTS OF THE USE OF THIS SOFTWARE IN TERMS OF ITS CORRECTNESS, ACCURACY, RELIABILITY, CURRENTNESS OR OTHERWISE. THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THIS SOFTWARE IS ASSUMED BY YOU. THE EXCLUSION OF IMPLIED WARRANTIES IS NOT PERMITTED BY SOME STATES. THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

* General
You acknowledge that you have read this agreement, understand it and that it is the complete and exclusive statement of your agreement with Micromat which supersedes any prior agreement, oral or written, and any other communications between Micromat and you relating to the subject of this agreement, and that your obligations under this agreement shall inure to the benefit of Micromat's licensors whose rights are licensed under this agreement. No variation of the terms of this agreement will be enforceable against Micromat unless Micromat gives its express consent in writing signed by an officer of Micromat.
